Terms of Service

Please read these Terms carefully. Section 15 contains a binding individual arbitration agreement and a class-action waiver that affect how disputes between you and BeachParked are resolved. You may opt out of arbitration within 30 days of first accepting these Terms (see Section 15).

1. Agreement to Terms

By accessing or using BeachParked ("BeachParked," "we," "us," or the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms apply to everyone who uses the Service, including visitors, account holders, property owners who list spaces ("Hosts"), and people who book spaces ("Guests"). You accept these Terms electronically when you create an account, list a space, or make a booking.

You must be at least 18 years old and able to form a binding contract to use the Service.

2. What BeachParked Is — and Is Not

BeachParked is an online marketplace that connects Hosts who have available parking spaces with Guests seeking parking. We provide the platform; we do not own, operate, manage, inspect, or control any parking space, and we do not take possession or custody of any vehicle.

The parking arrangement is solely between the Host and the Guest. BeachParked is not a party to that arrangement and is not a landlord, parking operator, broker, insurer, agent, or bailee of any vehicle or property. We do not control and are not responsible for the conduct of any Host, Guest, or other user, the condition, safety, or legality of any space, or whether a Host or Guest will actually perform. You agree not to involve BeachParked in disputes between users except where these Terms expressly provide for our involvement.

3. Accounts

To use certain features you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your credentials and for all activity under your account, and you must notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk.

4. Host Terms

By listing a space, you represent and warrant that you have the legal right to offer it for short-term parking, including any necessary permissions from homeowner or condominium associations, landlords, lenders, co-owners, or other governing bodies. You are solely responsible for complying with all applicable laws, regulations, association rules, leases, and zoning ordinances, and for all taxes on income you earn through the Service.

You agree to keep listings accurate, honor confirmed bookings, keep the space safe and accessible, and respond to Guests promptly. BeachParked charges Hosts a 10% host fee, deducted from the booking before payout; Hosts receive 90% of the listed price. Payouts are processed through our third-party payment processor, typically within 2–3 business days after the booking completes.

Operating Hours

Bookings are for daytime use only, from dawn to dusk. Overnight parking is not permitted. Hosts may not offer, and Guests may not use, a space outside these hours.

Cancellation & No-Show

If a Guest cancels 24 or more hours before the booking start time, the Guest receives a full refund and the Host receives no payout for that booking. If a Guest cancels within 24 hours of the start time, or fails to arrive (no-show), the booking is non-refundable and the Host keeps the full payout for that booking.

Overstay

If a Guest remains parked after the end of the booked period, BeachParked may charge the Guest an overstay fee of 1.5 to 2 times the daily rate, which is paid to the Host. Repeated overstays may result in suspension of the Guest's account.

Damage Claims

To be eligible for review, a Host must report property damage caused by a Guest within 72 hours of the booking end, with photo documentation. As described in Sections 5 and 8, the Guest is responsible for verified damage and BeachParked may charge the Guest's payment method; BeachParked does not guarantee any coverage amount.

Loaned Items (Beach Wagon & Optional Gear)

If you choose to make a beach wagon or other personal property ("Loaned Items") available to a guest, you do so voluntarily and at your own risk. You represent that each Loaned Item is yours (or you are authorized to lend it), is in safe and working condition, and is suitable for its intended use. You are solely responsible for the maintenance, condition, and safety of any Loaned Item. BeachParked does not own, inspect, insure, or assume any responsibility for Loaned Items, and neither BeachParked's damage protection nor the Beach Day Promise covers Loaned Items. You agree to release, indemnify, and hold BeachParked harmless from any claim, loss, injury, or damage arising from a guest's use of, or the condition of, any Loaned Item. Any dispute over loss of or damage to a Loaned Item is solely between you and the guest; you may report it within the damage-reporting window described in the Damage Claims section above, but BeachParked has no obligation to mediate, reimburse, or enforce such claims.

5. Guest Terms

By booking a space, you agree to use it only to park a permitted vehicle during the booked period, park only in the designated area, follow the Host's access instructions, avoid damaging the Host's property or surroundings, vacate by the end of the booked period, and provide accurate vehicle information. Guests pay a Service & Protection Fee in addition to the listed price.

You are responsible for any damage you (or anyone using your booking) cause to the Host's property, and BeachParked may charge your payment method for verified damage claims.

Items lent by hosts. A beach wagon or gear a host chooses to lend is provided by the host, not BeachParked. You use any such item entirely at your own risk and agree to return it in the condition you received it. BeachParked does not own, inspect, or insure these items and is not responsible for them.

6. Bookings, Fees, and Payments

Bookings are confirmed and charged at the time of reservation. Prices are shown in US Dollars and include applicable platform fees. Payments are processed by a third-party payment processor, and your use of payment features is also subject to that processor's terms. You authorize us and our processor to charge your payment method for bookings, fees, and verified damage claims.

Cancellation Policy:

Cancellations 24 or more hours before the start time receive a full refund. Cancellations within 24 hours of the start time, and no-shows, are non-refundable. Refunds are returned to the original payment method, typically within 5–7 business days. You agree to contact us before initiating a chargeback so we can resolve billing issues directly.

7. Assumption of Risk; Release Between Users

Listing, sharing, or using a parking space involves inherent risks, including property damage, theft, vandalism, towing, personal injury, and loss. You knowingly and voluntarily assume all such risks and agree that BeachParked is not responsible or liable for any property damage, theft, or bodily injury to any Host, Guest, or third party arising out of a parking arrangement.

To the fullest extent permitted by law, you release BeachParked and the other user from any claims, demands, and damages arising out of or related to the parking arrangement or the other user's conduct. If you are a California resident, you waive California Civil Code §1542 and any similar law, which would otherwise preserve claims you do not know about at the time of the release.

8. Host Protection Program

BeachParked may, at its discretion, offer a limited Host Protection Program to help Hosts with certain property damage caused by a Guest during a confirmed booking, subject to the program's separate terms (including timely reporting, photo documentation, and cooperation with the claims process). The program is not insurance, does not make BeachParked an insurer or a party to the parking arrangement, and does not expand our liability under these Terms. It does not cover normal wear and tear, pre-existing damage, weather or natural events, or damage unrelated to the Guest's use of the space.

9. Taxes

Each user is responsible for determining and meeting its own tax obligations. Where required by law, BeachParked may calculate, collect, and remit applicable taxes (for example, as a marketplace facilitator) and may report transactions to tax authorities.

10. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose; create fraudulent listings or bookings; harass, threaten, or abuse other users; circumvent the platform's payment system or arrange off-platform payments for bookings made through the Service; scrape, crawl, or use automated means to access the Service; impersonate any person or entity; post false, misleading, or infringing content; or violate any applicable law or regulation.

11. Content and Intellectual Property

The Service, including its design, logos, text, graphics, and software, is owned by BeachParked and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

You retain ownership of the content you submit (such as listing photos and descriptions) and grant BeachParked a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and promote that content in connection with operating and marketing the Service. You represent that you have the rights to the content you submit.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, and we do not screen, endorse, or guarantee the identity, conduct, or suitability of any user, or the quality, safety, or legality of any space. Any verification we perform is limited and does not guarantee anything.

13. Limitation of Liability

To the fullest extent permitted by law, BeachParked will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for damage to or theft of any vehicle, property damage, or personal injury, arising from or related to the Service or any parking arrangement, whether based in contract, tort, or any other theory, even if we have been advised of the possibility of such damages.

Our total liability for all claims arising from or related to the Service will not exceed the greater of (a) the total fees you paid to BeachParked in the 12 months before the event giving rise to the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest amount permitted by law.

14. Indemnification

You agree to indemnify and hold harmless BeachParked and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your parking arrangements, your content, your violation of these Terms, or your violation of any law or any rights of a third party.

15. Dispute Resolution; Binding Arbitration; Class-Action Waiver

This Section affects your legal rights. It requires most disputes to be resolved by individual arbitration rather than in court, and it waives class actions and jury trials. You may opt out within 30 days as described below.

Informal resolution first. Before starting arbitration, you agree to email a description of the dispute to hello@beachparked.com and give us 60 days to resolve it informally. Many issues can be settled this way.

Binding arbitration. If we cannot resolve a dispute informally, you and BeachParked agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (and its Mass Arbitration Supplementary Rules where they apply). This arbitration agreement is governed by the Federal Arbitration Act. The arbitration will be conducted by telephone, video, or written submissions, or in person in the county (or parish) where you live, consistent with the AAA rules.

Class-action and jury waiver. Disputes will be arbitrated only on an individual basis. You and BeachParked waive any right to a jury trial and waive any right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims or preside over any representative proceeding.

Who decides what. The arbitrator decides all issues, including the scope and enforceability of this arbitration agreement, except that a court — not an arbitrator — decides whether the class-action and representative-action waiver is enforceable.

Coordinated filings. If 25 or more similar arbitration demands are submitted by or with the help of the same or coordinated counsel, BeachParked may require them to be administered under the AAA Mass Arbitration Supplementary Rules, including in staged batches with bellwether proceedings.

Small-claims and injunctive relief. Either party may instead bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property or stop unauthorized use of the Service.

30-day opt-out. You may opt out of this arbitration agreement by emailing hello@beachparked.com within 30 days of first accepting these Terms, stating your name and the email on your account. Opting out affects only this Section and does not change the rest of these Terms.

Severability. If the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court while the rest of this Section continues to apply to all other claims. The rest of this Section is otherwise severable. This Section survives termination of these Terms.

16. Governing Law and Venue

Except for the arbitration agreement in Section 15 (which is governed by the Federal Arbitration Act), these Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Nothing in these Terms deprives you of the protection of any mandatory consumer law of the place where you live that cannot be waived by agreement.

For any dispute not subject to arbitration, the exclusive venue is the state or federal courts located in Indiana, and you consent to their jurisdiction — except where applicable law allows you to bring (or requires us to bring) a claim in the courts where you live.

17. Florida Marketplace Facilitator; Sales Tax; Tax Forms

BeachParked operates as a marketplace facilitator under Florida law, including Section 212.05965, Florida Statutes. For bookings subject to Florida sales tax, this means BeachParked — not the Host — calculates, collects, and remits the applicable Florida sales tax on the booking to the Florida Department of Revenue. You, as a Host, do not need to separately collect or remit Florida sales tax on bookings made through the Service, and you agree not to do so for those bookings.

The amount you receive as a Host is the booking price net of the platform fees and processing fees described in Sections 4, 6, and 18. Sales tax collected from Guests is handled by BeachParked and is not part of your payout.

For income tax reporting, payouts to Hosts are processed through our third-party payment processor, Stripe. Any tax form reporting your payouts (for example, a Form 1099-K) will be issued by Stripebased on the transfers made to your connected payout account, where Stripe is required to issue one. You remain responsible for your own income taxes. This Section is a plain summary of how tax collection works on the Service and is not tax advice; consult your own tax advisor about your situation.

18. Payout Routing and Application-Fee Authorization

To receive payouts, Hosts onboard with our third-party payment processor, Stripe, and open a connected payout account. By listing a space and completing payout onboarding, you authorize BeachParked to route Guest payments for your bookings to your Stripe connected account, and to deduct, before payout, the BeachParked platform application fee and the applicable payment-processing fees.

The platform application fee is currently 10% of the booking price by default. The applicable rate may vary for a given Host or booking — for example, under a promotional or referral arrangement — and the rate in effect for a booking is the rate disclosed to you at or before the time of that booking. Payment-processing fees are charged by Stripe.

Your use of the connected payout account is also governed by Stripe's own terms, including the Stripe Connected Account Agreement and Stripe's payout terms, which you accept when you onboard with Stripe. Payout timing is determined by Stripe's payout schedule (typically a rolling basis after a booking completes). BeachParked is not your bank and does not hold your funds as a deposit.

19. Changes to These Terms

We may modify these Terms from time to time. We will post the updated Terms and update the "Last updated" date, and for material changes we will provide reasonable notice. Your continued use of the Service after changes take effect means you accept the updated Terms. Changes to Section 15 will not apply to any dispute for which a proceeding has already been filed.

20. General

These Terms (with any policies referenced here) are the entire agreement between you and BeachParked regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. We are not liable for delays or failures caused by events beyond our reasonable control. Nothing in these Terms creates any agency, partnership, employment, or joint-venture relationship between you and BeachParked. You consent to receive notices and communications from us electronically.
